Goldstein Hall’s Litigation Team, led by Senior Associate Peter M. Rivera, secured Summary Judgment, dismissing claims brought against a small community church in an action for specific performance, brought by an alleged purchaser of the church’s property in Brooklyn, New York. The Motion for Summary Judgment, entered in Kings County Supreme Court, was the culmination of five years of litigation on this matter. It concerned the intricacies of mutual mistake of fact when two parties enter in to a contract for the sale of real property.
Specifically, the Court determined that the church was entitled to Summary Judgment because a substantial fact, which formed the underlying basis of the transaction, was based upon a mutual mistake. Goldstein Hall’s Litigation Team, following discovery, was able to find and introduce vital information that benefitted the Church regarding the parties mutual mistake. The Court decided that no further triable issues of fact were needed for it to rescind the contract and dismiss the complaint in favor of the church.
