On December 5, 2019 the New York City Department of Buildings (DOB) began enforcing Local Law 110, which requires building owners to notify tenants of any DOB violation issued against a property.
For any DOB/OATH summons issued after December 5, 2019 for a condition outside of an occupied dwelling unit, the owner must post a copy of the summons along with a copy of a DOB flyer that contains information regarding the procedures for resolving violations and holding an OATH hearing. Both the DOB summons and the flyer must be posted in a conspicuous manner in the building’s lobby until the violation has been resolved. The summons and flyer must be posted no later than five (5) days after the summons is served. A copy of the flyer can be found here.
For violations relating to a specific unit, the owner must distribute a copy of both the summons and the flyer to the resident of the impacted apartment and the residents of all apartments adjacent to the impacted apartment.
